Amidst Mueller’s investigation into Russian interference in the 2016 election, Trump has been slapped with another serious lawsuit. Back in September, it was alleged that the president was violating the Constitution’s foreign emoluments clause. According to NPR:
‘IN THE ROUGHEST SHORTHAND, THE CONSTITUTION’S FOREIGN EMOLUMENTS CLAUSE SAYS FEDERAL OFFICIALS CAN’T TAKE GOODIES FROM THE GOVERNMENTS OF OTHER COUNTRIES. CITIZENS FOR RESPONSIBILITY AND ETHICS IN WASHINGTON, OR CREW, SUED PRESIDENT TRUMP THREE DAYS AFTER HE TOOK OFFICE. IT SAID TRUMP IS, QUOTE, “SUBMERGED IN CONFLICTS OF INTEREST DUE TO FOREIGN GOVERNMENT SPENDING AT THE D.C. HOTEL.’

Now it looks as if Attorney Deepak Gupta is set to present oral arguments in this case on Wednesday morning in Washington D.C.
Gupta’s law firm said on its website:
‘WE ARGUE THAT THE PRESIDENT IS VIOLATING THESE CLAUSES IN A NUMBER OF WAYS, INCLUDING THROUGH PATRONAGE BY FOREIGN AND DOMESTIC GOVERNMENTS AT THE TRUMP INTERNATIONAL HOTELS IN WASHINGTON, D.C. AND NEW YORK, LEASES HELD BY FOREIGN GOVERNMENTS AT NEW YORK’S TRUMP TOWER, AND OTHER BUSINESS DEALINGS IN FOREIGN COUNTRIES.’
Trump argues that he is not in violation of the Emoluments Clause because he handed over management of his family’s companies to his children and handed over ownership of his personal trust. It is debatable though, as to what constitutes an emolument and Trump would argue that his hotel business has nothing to do with being president so therefore, there can be no emoluments.
However, John Mikhail, a professor at Georgetown Law School, disagrees after surveying all 40 existing dictionaries between 1604 and 1806 that define emolument. According to Peter Overby with NPR:
‘MIKHAIL SAID ONLY THREE DEFINE THE WORD IN WAYS FAVORABLE TO TRUMP.’
Overby also said:
‘THE THREE WORDS MOST OFTEN USED TO DEFINE EMOLUMENT WERE PROFIT, ADVANTAGE AND GAIN.’
Gupta will begin arguments this week in attempts to decide what emolument really means and whether or not it applies to Trump’s hotel dealings with foreign governments. Many of us can speculate that it most likely does, but it is up to the courts to decide, or there is a high probability that Congress will have the final say in the matter.
According to Overby:
‘CONGRESS HAS BEEN APPROVING OR REJECTING EMOLUMENTS FOR LESSER OFFICIALS FOR MORE THAN 200 YEARS. ANOTHER WAY THE ISSUE COULD COME UP, IF MEMBERS OF CONGRESS MOVE TOWARD IMPEACHMENT.’
